Declaration of Independence designed to break away from a government and no government can trample on citizen rights.
Constitution is the supreme law of the land designed for establishing a government
OK, you meant to say "Declaration of Independence" not "Constitution".... Then what you first said makes more sense.
The distinction matters a lot, because if a right asserted by the DoI is infringed your recourse is very different than if a right asserted by the Constitution is infringed.
