“By an act which is greatly dangerous to another's life and evidences a depraved mind which has no regard for human life“
So among the standard 1st degree murder types, New Mexico is the only state I have ever seen making “depraved heart murder” a first degree capital offense. Not a lot of states even have this law. It goes back to the common law and is essentially a form of extremely reckless and egregious homicide.
California has it, and the link above is a good brief intro. People v. Knoller was a pretty big case in California about this. Those moron defendants did a lot of press conferences. I think there is even a made for TV movie about it.
Shooting your rifle in the air on New Years and then wherever the bullet came down it killed someone, if your state has this statute you will be charged with depraved heart murder.
To me, in the aggregate, all of these “reckless” examples rise to a depraved level. He should be charged with 1st degree depraved heart murder imo.
On another note, why why why are news sites reporting legal matters WITHOUT the damn filings from the case? Ive been trying to hunt down the probable cause statement and I cannot find it anywhere.
