It doesn't matter. Either way it will go all the way up to the SCOTUS. We have to hope they will take it.

Why do you and others think it will go to SCOTUS? They've already indicated States run their elections. How is this a constitutional matter? It is a criminal matter, for sure, but they don't do criminal trials.
