Simple, short of having cash bail: Pros: not having to lock up every accused person that is a flight risk (costly) Cons: allows profiteering from the bail loans game (mitigated by transfer of risk to bail bondsman which allows poor people to access same rights as rich people)
Of not having cash bail: Pros: ? Cons: either all accused will need to be locked up or let free, grave injustices rampant both ways
Important point- just because people violate, abuse or misuse a law doesn't make the law wrong, but underscores the need for putting people in that will properly recognize and enforce it. Changing a valid functional law doesn't change criminal behavior. Making clearer or stronger penalties for the law breakers and their accomplices may be the better remedy.
