Even as a Guard member not on duty weekend, you can still be tried under the UCMJ if you are an Active Reservist. Coincidentally, Clown members can be charged under th UCMJ as well as Congress critters even though neither of those groups are DOD employees.
Your question is one I'd like to see DOD answer, though. Brings up a very point. How did he access those files if he wasn't on duty, IF he was even the person who accessed and distributed them. I'm wondering if the U.S. Govt is charging him in an attempt to get to whoever did actually gain access.
