The question is what does Congress do now? They don't have enforcement powers.... or do they? Will the Capital Police enforce the violation? Who is the ultimate power when it comes to Washington DC? The Constitution grants the United States Congress exclusive jurisdiction over the District in "all cases whatsoever". The Capital police answers to the Capitol Police Board and is the only full-service federal law enforcement agency appointed by the legislative branch of the federal government of the United States.
It appears that Speaker McCarthy can 'motivate' Capital police leaders by threat of removing them. If so, McCarthy needs to start throwing his weight in this matter.
If they take it to court, it will be drawn out in endless motions and counter motions.
There is one power than can remove them, and if they are not going to follow the rule of law, they need to be removed. Congress can de fund them as a branch of government. If it comes to that then the FBI and other three letter agencies deserve to be de funded. I know that's a harsh statement, and that most of the rank and file Agents are great people doing a job. however if the leadership is rotten, then it paints the rank and file in a very bad light. If Leadership is giving unconstitutional orders, and they are following them, perhaps they need to go into whistle blower status?
The power of the purse has become a figurative act. The bottomless pit of dark money and budgets that's completely outside of Congress' knowledge and control makes Congress' 'power of the purse' a neutered exercise. Withholding FBI funding would create a backdoor for money to come in to fill the void. It's possible the Biden Administration could re-appropriate money from other State Agencies to the FBI. I see this as a real possibility with all the other outrageous acts this regime has done.
