It wouldn't. This is why we have the national guard. Also, the state is allowed to call up the citizens into a militia for defense.

Aside from that.. martial law, illegal curfews, and illegal detainment have all happened in this country. Recently, event. That's why the oath to the constitution requires you to defend it. It's nothing unless it's own citizens defend it.
