This is definitely the case, and a smart person would probably phrase it this way on purpose to goad this response.

Unfortunately this is the crybaby formerly known as Kinzinger, so it's probably just because he's too stupid to see that he's reinforcing this belief.

Definitely would not hold up as an admission of guilt, but also definitely something to keep in the back pocket.
