What is the punishment of violating the 1st amendment? I don't don't think the founders gave a redress. Doesn't that mean that the court can decide? I think the only remedy would have to start with the immediate removal of all guilty parties? No? I hope so. Maybe this is when we have a military govt until the election.....
We do have a remedy under federal law (and probably state laws are similar).
18 USC 241: Conspiracy Against Rights
We are talking the dealth penalty here.
Maybe State AG's also need to consider trying to establish a new legal doctrine whereby if the federal government empolyees refuse to enforce their own laws, then the states can use federal laws and enforce them wholly within State courts and prisons, and that includes arresting, prosecuting, and punishing federal employees.
Would be great for legal minds to have a discussion about how to go about doing this.
We also should repeal the 17th Amendment, which is an unconstitutional amendment in the first place, and is the reason why the States do not have the power they were originally intended to have over the federal government.
As to the last paragraph, I agree the 17th amendment should be repealed, but I can’t understand how an amendment to the Constitution could be unconstitutional.
Way too many people on both sides of the aisle sloppily use "unconstitutional" to mean "I don't like it".
