If you rape a child, they have to deal with that for ~90% of a lifetime. Killing the perpetrator only robs them of maybe 50-75% of their life, depending on age. Kennedy was right, it's not proportional because it's not enough punishment. Maybe the government should use robots to ass fuck the perpetrators in a proportional way. That might be fair. Is it cruel and unusual punishment? I would argue it's not, because their crime was equally cruel and unusual.
This is why capital punishment is truly a deterrent, despite arguments against it. It may not deter others from committing the crime, but it deters the executed from committing it again.
