I remember when there was the notion that judges didn't interpret the law, but rather judged if you broke it and what appropriate punishment would be within the boundaries of the law.

I wish this ended up being reality.

It should be up to a jury to decide, but the courts mostly bully the defendant into giving up his rights to a jury trial.

Even then, all juries are tainted now. I'm not sure if it's even possible to get a fair trial anymore.
