I hate to break it to you, but the vaccine is still mandatory for some of us. Me and my children are US citizens and I still can't move back to my own country because my wife is can't get an immigration visa. Have you tried to get an exemption? This has worked for a few people I know. Albeit not with "USCIS".
In our case, we don't have the best case. My wife has a vaccine from a previous application a few years ago. So the "born again" approach is kind of a long shot.
What amazes me and pisses me off is that this is still a thing at all. The requirement is not needed for non-immigrants and illegal immigrants. And it's the official policy of the US government to murder and maim people applying legally!!!?????
Edit: Side-note the way the law is written, you need to have a religious reason against ALL vaccines. So you can't say I don't want the clot shot because it will modify my DNA, or it's unsafe. There's no way to selectively opt-out of the covid shots.
Courts have established that you can't use past actions as legitimacy tests to prove authentic religious belief. I went through this during 2021 when mandates were everywhere and I lawyered up. You need an attorney and that will get you sorted.
This would actually be a lot easier if it were a court. A waiver to USCIS is done at the whim of the officer assigned to it. They could give me a pass, or they could deny it, which would be left on my application that I was refused entry and that would make any future attempts that much more difficult.
I've been told by three different lawyers that this this not something that would be extremely difficult to get into a court, and there is no case law in this area to draw from.

All you need is the US Constitution, my friend. It's been a while since I read the pertaining articles, so you'll need to read and verify yourself. I read through and if memory serves, Article 9 and Article 14 (section - maybe 3 or 6?) very much pertain and possibly even Article 8. Again, I looked for this when this whole covid shot mess started, so I'm going off memory, which isn't great. ALWAYS look to the Constitution for your help.
