I will go out on a limb here and declare that SCOTUS knew exactly what they were doing when they nullified the injunction the other day while that case is adjudicated by the 5th Circuit. Now that case is over barricades in the Rio Grande but the real issue here is Article 4 Section 4. It was by nullifying the injunction that this declaration by Abbott was triggered. Now when this reaches SCOTUS it will be a question surrounding Article 4 Section 4 and the issue of Federalism vs State Sovereignty that has been argued since the very inception of our Republic. This goes to the very heart of our understanding of our Republic and the underpinnings of our nation.
Whats one of Trumps favorite catch phrases? "Complicated business, folks."
Wonder if this is beginning of states taking back their power… drilling, EPA, borders etc. The attorney generals have been filing lawsuits one after the other for their states. This will be interesting to watch play out.
This question has plagued us since the very beginning of the Republic and I think it is at the root of who we are and how we choose to govern ourselves. Its high time we put this issue to rest.
The Constitution makes it clear that the States are sovereign and limits the feds power to only that which is explicitly outlined in the Constitution. But those States rights have been eroded and the States coerced with Federal grants to relinquish that sovereignty. At the same time, there has been a two century long gaslighting and propaganda effort against the People to force them into the belief that the Feds rightfully maintain all the power.
I think this border issue is not only going to prove that the feds act with treasonous intent but also educate the People by showing them that the Federal governments main purpose is to ensure the sovereignty of the States. In a similar vein and parallel to this battle, the Chevron doctrine has eroded the rights of the People and given them to unelected bureaucrats.
With these issues resolved, the bloated federal government can be peacefully dismantled and we can get back to the original intent of the Framers.
