Just to answer: Mineral Rights. Basically anything that’s a resource below the ground is owned by the Feds or State unless those farms/people personally own the Mineral Rights.
It goes back to the Gold/Silver/Oil/Gas mining laws establishment days. Water is included in that. Like most if not all of the US, even if you “own” the property, you have to get a permit in order to have a Well put in to pump water out. Or to mine anything off your land if you don’t own the Mineral Rights.
I thought mineral rights accrue to the property owner unless he has sold them, e.g. to an oil company. How else could a property owner sell mineral rights to an oil company if he didn't have them?
IF the state "owns" the water, what gives it the right to deny it to homeowners and farmers, so that they can enjoy their property rights and earn a living?
WHO do they WANT to have the water? If not the individual property owner and farmer??
City dwellers? Industries?? come on man!
I know. It’s dumb! But this is how they control your property besides taxes, literally right under your feet.
