Why would he say that if he wasn't going to testify. He had to know it was untrue. He got his lawyer to agree to it and his lawyer obviously knows it was untrue.
I think he was signaling to the public he's changed his mind about testifying.

You can testify when you’re under a gag order. The judge even called Trump out after he made that statement.
