I am not sure how Palestine, or Judea, or whatever, becoming a UN member - i.e. a soveriegn state asking for membership, is 'shredding the UN constitution' .
It is not up to third party states, BTW, it is up to the state itself:
A State seeking membership to the UN first submits an application to the Secretary-General. The State also makes a formal declaration, stating that it accepts the obligations of membership as stated in the UN Charter. The SC considers the application.
