I still don't understand the 6-3. KBJ recused herself for the Looper case because it was before her prior to becoming a justice. I think there were 2 cases combined though - Relentless and Looper. Everyone is parroting 6-3, but I don't believe she was allowed to deliberate in part of that. Maybe someone else can figure this out, but there were a bunch of articles earlier in the year about her recusing herself.
