One thing to be mindful of is not to blur the lines too much towards prosecuting anyone who said something mildly threatening. Regardless of what happens in the next 4 years, the day will come when the other side once again takes control of the government, and the less power they have to go after political opponents and dissidents, the better.
Precedent should always favor freedom of expression (however retarded that expression may be), and reserve prosecution for REAL, probable threats of violence.
