Maybe they'll assert she can hold both offices simultaneously until a new Veep is appointed. By the time any lawsuits work their way through the courts the election will be over and it will be moot.
Once VP is chosen he/she has to be voted on.
Section 2. Whenever there is a vacancy in the office of the Vice President, the President shall nominate a Vice President who shall take office upon confirmation by a majority vote of both Houses of Congress.
What if they can’t reach a vote?
