Federal Law is what should be applied here. The first line of the Uniform Residential Loan Application (HUD 1003) states:

"A material false statement on this loan application is punishable by up to 30 years in prison and a $1,000,000 fine".

That penalty applies on every one of those loans. By law Maryland could never be his primary residence since his job requires him to reside in California.
