California Gov. Gavin Newsom (D) convened the state legislature for a special session on Monday designed to “Trump-proof” the state, including by passing $25 million for use in lawsuits against the incoming administration.
As Breitbart News noted after the election in November, Newsom announced the special session — not to deal with pressing problems facing the state, but rather for the political purpose of leading the so-called “resistance” (i.e. opposition) to President-elect Donald Trump.
Trump responded on Truth Social, saying Newsom was “using the term ‘Trump-Proof’ as a way of stopping all of the GREAT things that can be done to ‘Make California Great Again’.”
Newsom boasted Monday that his administration, unlike that of his predecessor, Jerry Brown, would not simply react to Trump policies, but would go on the offensive against them. He claimed that the state had succeeded in the past at reversing many Trump policies at the “agency level.” (He may have been referring to Trump’s decision to withhold $1 billion in funding for the high-speed rail system California never built; President Joe Biden restored that funding.)
The governor also claimed that no state leader had worked more closely with the Trump administration during the coronavirus pandemic, and that California had still managed to maintain its lawsuits against Trump, regardless.

Though Democrats control supermajorities in both houses of the state legislature, the state shifted right in 2024, and nearly 40% of Californians voted for President-elect Trump rather than California’s Vice President Kamala Harris.
Newsom is thought to be posturing, in part, because he is among the presidential frontrunners for the Democratic Party in 2028. He declined to run as an alternative to President Joe Biden or Vice President Harris in 2024.

It's kind of a long story, but I have been trying to get Scott Wiener vacated from office for the last year for working unlawfully without an oath.
I recently realized that a lot of state senators and almost every staffer (deep state employee) that I checked are also working unlawfully without an oath or bond.
I started a petition, and every few days, I send a follow up email to over 100 state senators and staffers. I sent today's email before I knew about today's special legislative session. The session makes my email is all the more relevant:

This is a reminder that you are each responsible for yourselves.
I have documented that Erika Contreras, John Nam, Lynne Cervinka and Sheila Braverman have been criminally conspiring to evade the federal and state oath/bond laws. This failure by leadership to comply with laws does not absolve each of you of your personal responsibility to have a current, fully executed oath that complies with the constitutional requirements and a surety bond filed with the Secretary of State.
YOU are the one who will go to prison if the Trump administration and/or the military chooses to prosecute these crimes. The argument that leadership told you the expired oath was still valid and that surety bonds aren’t required won’t hold up in court -- especially since I have repeatedly shown you all the pertinent laws and the State Senate has not denied that my interpretation of the laws is correct.
I realize that no one has been prosecuted to date for failure to comply with oath/bond laws. However, since the election, the California governor and many legislators -- including Scott Wiener -- have been boldly proclaiming that federal laws/rules do not apply to California. These people have basically dared Trump and the military to go after them. It will not surprise me if Trump accepts that dare.
I strongly recommend that each one of you do what you need to do to ensure that you are lawfully employed (and thus not caught up in the cross-fire).
Also, please do not forget that working without an oath is considered to be the crime of fraudulently posing as a government agent. There is no statute of limitations on fraud, so Trump can go after you for each and every year you were working without a current oath in place.
Finally, as we start the new session, please remember that each of you are public servants. You have been given power by the people to act on our behalf in accordance with our wishes. In recent years, the State Senate has behaved as if they are a monarchy and not public servants. I hope that this session, each one of you will remember that “we the people” can take our power away from you if you do not properly serve us.
