I believe the first case was rejected and was asked by the court to be rewritten, it was and is still on the docket and could be voted on at any time.

I'm not an expert on the Brunson cases, but I'm pretty sure there were 3 that filed lawsuits.

Plus the way at least one of them was 'dismissed' left the door open for it to be heard in the future.
