What I can't understand is how the jury could be deadlocked on the more serious charge, but unanimously agree on a verdict of innocent on the lessor charge. Anyone have thoughts on this?
They were following the judges orders to the letter. The jury only declared a Count I deadlock because the jury instructions explicitly said the jurors must first decide Count I and only then move on to Count II.
The rat judge was hoping by moving to count II after the weekend Penny might get tagged with something.
