Maybe Johnson is a white hat and is doing something that looks bad on the surface yet when it plays out his actions will make Congress deadlocked, thus resulting in Trump getting his nominations through Congressional recess appointments. Like Pence did so the vice President doesn't have any control in the electoral college any more.
