I hate this. Cops will use it to keep citizen journalists and Cop-watchers from filming regular police encounters.
The only way I would be remotely okay with this is:
if It only applied to officers and agents with body cameras
Officers would be immediately fired and charged with destroying evidence for turning off their bodycam during an encounter
If they turned off their bodycam any charges against any CITIZEN they were arresting would be dropped (IDGAF about illegals. That's a different category)
Obtaining that body camera footage should also be a very quick and easy process. Any attempts by LEOs to stop citizens from getting the body camera footage should carry obstruction charges
officers, departments, and the state should be financially liable and sued anytime they step out of line and abuse this to promote a policy of transparency and avoid misuse.
Police departments and cops rarely police each other. The thin Blue line and the fraternal culture leads to a lot of abuse. (Cops rarely arrest other cops and disciplinary action against cops typically just ends up being a slap on the wrist or them moving departments) Police are extensively trained on how to circumvent your rights. This gives them another very powerful tool.
