This could work with a constitiutional limited Federal Government. It would not work with a Federal Government like we have now. Maybe President Trump is giving us hints about how things are really going to be with Limited FEDERAL Government. States can do whatever they want within the constitution. Their people will still have common rights. Plus the states will have to complete with each other. That itself is an awesome check on power.
