It's been filed multiple times. The SC haven't turned it down outright, though. They would, if the case was truly "dead in the water". It's still lurking.
Which makes me think that the Brunsons have a point, of course they do. And then it's a matter of timing. The result would be most members of congress would be possibly removed for breaking their oath to uphold the constitution. But that would be extremely disruptive. So perhaps there is another plan as well (shutdown?)- to prepare the population.

SCOTUS has declined to hear it twice...it's dead. The lower court ruling against them stands.
