In your opinion, by what you see and read in the X post here, were the Jackson Hewitt employees showing people who are here illegally how to file for tax returns?
It depends on if NY will give anyone an ITIN # like CA does and what you define as illegal.
If NY gives every migrant who wants one an ITIN #, the state views them as legal. Then Jackson Hewitt would only file a state return for those people, not a federal return.
If NY does not give out ITIN #s like candy, then Jackson Hewitt would only be doing returns for federally recognized legal migrants (asylum seekers, etc).
In CA, the state level EITC is a carrot to entice illegals to register for an ITIN #. Since CA and NY are so similar in policy, my guess is NY probably doing the same.
