Judicial discretion is the power of judges to make decisions based on their individualized evaluation, guided by the principles of law. This power allows judges to consider the unique circumstances of each case rather than applying the law rigidly. For example, in Ohio, Rule 59 of the rules of civil procedure allows courts to grant a new trial based on their "sound discretion".
However, the exercise of discretion must not go beyond constraints set down by legislation, by binding precedent, or by a constitution, as doing so can be seen as judicial activism and may lead to decisions being ultra vires.
