Donald Trump as 1 or 2 can receive judicial review.
Donald Trump as CIC does not receive judicial review as he is in charge of the military and their decisions.
If the Commander-in-Chief had judicial review, we would never win a war ever again. We'd be tied up in the courts while the enemy bombed us to oblivion.

He was driving home the point that the SCOTUS has NO BUSINESS being involved in the military.
