Even if she would have been illegal I can’t see how it would affect Barron’s status. His father has always been an American citizen, therefore he would be born an American citizen as well, correct? I used to work with a young lady who married an illegal. I always assumed their daughter was an American citizen. How could you take an American woman’s baby away from her?
That said, it should never happen outside of extreme circumstances (ie clear child abuse declared via trial by jury, or treason IMO)
That said, if her husband didn't come legally, and refused to take part in immigration via marriage, then he may be removed. It is easy enough to apply for legal status if you are married to a US citizen & have a real desire to remain a family.
