I don't believe they were trying to use J.Epp as a distraction.
They had those grand jury motions already researched (many cases are cited in them) and written, to submit at any time.
What they needed was to be able to show public support for the release of grand jury information, which the system is against doing. We'll have to see if the judge thinks there's enough public interest - but the Dems literally walked right into the trap, because they think The Boss is in the files. Congress actually tried to legislate the release.
