The hashtag should be banned, along with similar hashtags. They are not serving any legitimate purpose.

I agree with you on that -- but I'm not saying ban their posts, just the 'trending' hashtag.

I'm pretty sure that 1A doesn't give anyone the right to define a company's algorithm that declares something 'trending'.

The 1st Amendment doesn't give anyone a right to anything. It only enjoins Congress from abridging freedom of speech. The right is God-given. You would need to prove fraud or libel to have any legal action against it. And why should anyone care about which hashtag is "trending"? How could it ever be proved or disproved?
