I know nothing on this, but to be as fair as I can, I'd say we don't know what he saw or didn't see based on this video. Kirk went down very fast, could be this guy was glancing at his phone when it happened and didn't even know anyone got shot and is now taunting at wherever the shot came from.

I have no idea though, that is just a made up scenario where I am trying to give the largest benefit of the doubt.
