Isn't that what discovery is for? You dont have to have all evidence up front to arrest someone... just probable cause.

IANAL, but I think that discovery is for presenting the evidence.

And that the evidence is what gives your accusation probable cause.

Trump was accused without probable cause, and put through the legal system (the process is the punishment) without probable cause.
