I don't know what the Founding Fathers had in mind but I think defining it as maiming and torture (mental or physical) would be appropriate, and that keeping a man locked in a cage for the rest of his life should qualify as mental torture.

I started this thread saying that the endless appeals process is "cruel and unusual Punishment." That is because the families and the state need justice. The trial should take place within 90 days of arrest, and if there is a murder or manslaughter conviction, the public execution should take place within two weeks of the death sentence if delivered by the jury.
But if you want cruel and unusual punishment, the Bush 43 administration is the way to go. They did unimaginable torture at Gitmo with terrorists.
