36:42 Silk: why was the Tina P. habeas corpus writ denied?
Atty. Ticktin: in the Younger case this gives judges kind of an excuse, that the judge can deny habeas corpus if there is adequate opportunity at the state court to raise federal / constitutional issues and the judge doesn’t see any resulting irreparable harm if the judge denies granting freedom (habeas corpus).
Ticktin: But there is an exception to this because if we could have shown [in Tina’s case] irreparable injury that was “great and immediate” then we would get the write of habeas corpus.

Here's what the magistrate judge did wrong in Ticktin’s opinion:
The magistrate’s looked at the issue of Tina’s issue as a freedom of speech issue, & framed in his mind that her argument = she was denied habeas corpus (at the state trial court leve) because Colorado and the judge didn’t want her to be free to speak her truth The magistrate framed in his mid that Tina was being punished by being denied her freedom to speak, and this did not cause her immediate and great injury.
Att. Ticktin: [the judge did not characterize Tina‘s argument properly, the part about irreparable injury she is suffering .] the INJURY is that she is 70-year old lady, being made to stay in jail for a nonviolent crime, and they keep her in with violent criminals [+ her health is suffering in the prisons’ deplorable condition.]
This is their way of “punishing criminals who are not able to conduct themselves properly.” [This is not the proper place to have Tina P.]

Atty. Ticktin, with 1/3 of one of her lungs removed previously for cancer, Tina has the exact same cough now that she had with cancer. She needs a CAT scan. “She is not getting the treatment that she needs.”
49:11 Silk: DOJ Civil Rights Division, Harmeet Dillon, has begun an investigation into the entire prison system of Colorado for multiple reports of unconstitutional & “legally insufficient” conditions, prisoners have civil rights. … Tina P. with her condition at the age of 70, she is really considered disabled, is she not?
Atty. Ticktin: the facility she is in is not suitable for people to live. In the winter the temperatures get down to the 50s. The rule is … no lower than 65 and no higher than 75. It’s down to 50s in the winter. This place is not fit to be a prison. …. The governor is really so stupid he thinks he is so smart he is going to tell the President to “go pound sand” and keep [Tina] prisoner in custody, out of sight, and “think that the President of the United States doesn’t have any power to do anything about it?”
Atty. Ticktin: the warden, if he is concerned about her safety,has these options:

move her to Denver (no violent criminals in the prison there)

move her to Unit #2 because there is no danger over there, or
-
put her “in the hole” (solitary confinement.” This warden needs to be brought up on charges
____ Closing: Silk:is processing what is happening to Tina, and grieving, and prays that whatever blessings were going to be heading her way, she passes them on to Tina, she needs a miracle.
