Where did the Commission (EU top) get this authorization from to act "ON BEHALF" of any member state to create the APA?
What I would suggest is that the Bureaucratic mechanism within the EU are primarily responsible and that a post hoc justification and legalization has been entertained. This explains why all these EU member states where in such a hurry to make it legal.
