It was. Ironically Justice Thomas calls that out in his dissenting opinion.
That Historical Context and Common Sense would dictate that the 14th Amendment was only ever meant to apply to the children of Freed Slaves. And any other interpretation is flawed and based off modern political interests.
But 3 were guaranteed to rule against it regardless of context. And both Robert’s and Barrett have adopted children and connections to shady adoption agencies. So them ruling against was all but guaranteed.
Kavanaugh disagreed with the majority as well. His view however was the President didn’t have the authority to unilaterally revoke it. It’d take either an amendment or act of Congress. Both of which are unlikely but. I suppose a man can dream
Thomas, Alito, and Goursch all sided with Trump unreservedly
5-4
Robert’s, Sotomayor, Kagan, Barrett, and Jackson ruled in favor of striking it down.
Thomas, Alito, and Gorsuch dissented
Kavanaugh had a split opinion in that he both partially agreed and disagreed.
Basically the 5 Women on the court versus the 4 Men.
Jackson shouldn't be there! That DEI judge is illegally on the bench. Biden had no authority to put it there in the first place.
they need to go after the baby dropper travel trade...
Not enough.
Terrible decision. The 14th Amendment was clearly written regarding slavery.
