The quantity of all calibers of ammunition produced daily runs into the tens of millions of rounds. The quality standards are high, but there can be the occasional dud round. Frequent enough that pistol training accounts for how to handle such an event. It happens also with rifles. A particularly wicked occurrence is for a round to fail to exit the barrel, but the shooter thinks it has...and fires another round. Which collides with the one already stuck in the barrel, usually deforming the barrel.
Police statistics also record every manner of bodily response to a gunshot. Kinetic energy means less than one might think. I once figured out a hot cup of coffee had more thermal energy in it than a rifle bullet had kinetic energy. The body handles energy quite well. The terminal effects are dominated by the momentum of the bullet, a different number. If the shot was a dud round, the velocity may have been anywhere from 50% to 30% of the rated value, and the momentum would decrease in proportion. The bullet could have been traveling no faster than a pistol bullet, and that would be compatible with the terminal effects.
Supposedly, the "new evidence" includes more detailed surveillance video. And fingerprints on the key pieces of evidence.
