Several podcaster influencers that I have watched have Infomercials offering help with tax debts and back taxes, etc. this seems odd to me because they have also said that "the IRS is illegal" and "the IRS is being abolished."

I have no income that requires taxes (disability) but I have now become my 62-year-old sibling's Guardian and according to the court, I have to file her returns. I also am the executor of our brother's estate and I am being told I have to file his tax return.

Just curious... any frens who can help me understand this one gray area - please only provide positive responses. I am in no mood to be beaten up for being naive.

What ICE can do (lawfully)

U.S. Immigration and Customs Enforcement may arrest someone only when at least one of the following exists:

1. A valid warrant

There are two different kinds, and this matters:

Judicial warrant (signed by a judge or magistrate)

Required to enter a home without consent

Strongest form of legal authority

Administrative immigration warrant (ICE Form I-200 or I-205)

Signed by an ICE officer, not a judge

Allows arrest only in public places

Does not authorize forced entry into a home

Administrative warrants are not criminal warrants and do not override Fourth Amendment protections.

2. Probable cause or reasonable belief

ICE must have individualized suspicion that:

the person is removable and

the person is the specific individual named in the warrant or record

They cannot act on:

race

accent

language

neighborhood

proximity to others

“being around undocumented people”

That would be unconstitutional profiling.

3. Consent

If someone voluntarily:

opens the door

lets officers inside

answers questions

What ICE cannot lawfully do

Courts have repeatedly rejected “round-up” style enforcement when challenged.

Why this misconception exists

ICE enforcement often looks chaotic because:

Having trouble educating my sister, who is 61 and has a heart murmur. She is hardheaded and stubborn as a mule.
