"In courts-martial and Article III courts, the evidentiary rules generally require that physical evidence gathered by law enforcement must have been obtained through the use of a search authorization. In military commissions, the prosecution must often rely on evidence gathered during military or intelligence operations, in which search intelligence operations, in which search authorizations may not have been appropriate or required. Military commissions evidentiary rules therefore do not require that physical evidence was obtained pursuant to search authorizations."

Dumb question then but if we control the NSA & other 18 intel agencies, why do we need to physically grab ANY computers?
That's what also never made sense to me about the alleged "raid in germany to grab the server" - if our intel agencies have even 25% the capabilities they are alleged to, we shouldn't need any physical computers, servers, or anything from anyone, right?
They should just have EVERYTHING electronically, right?
The physical computers CORROBORATE any evidence the NSA may have.
True, true...... ok. I get it now. Between this & denying her the access to whatever she's got on there, NOW I get it..... :-)
