There are a few comments on the oath of office and wanted to point out that it isn’t the oath, but the date and time, that determines when a new term begins.
However, according to Article II Section 1 of the Constitution, the oath must be taken before executing the duties of the Office of the President.
The previous term ends and a new term begins at precisely Noon on January 20th.
Twentieth Amendment - Section 1
The terms of the President and Vice President shall end at noon on the 20th day of January, and the terms of Senators and Representatives at noon on the 3d day of January, of the years in which such terms would have ended if this article had not been ratified; and the terms of their successors shall then begin.
U.S. Constitution, Article II Section1
Before he enter on the execution of his office, he shall take the following oath or affirmation: "I do solemnly swear (or affirm) that I will faithfully execute the office of President of the United States, and will to the best of my ability, preserve, protect, and defend the Constitution of the United States."
I’m not sure about all of that but I do think that Trumps term has to end before the next step can begin.
Yes I would agree with that. Perhaps that is where the mechanics of FEMA and the Military come into play.
So if all it takes is using the state of emergency to pass it to FEMA and the military at 11:59a on Jan 20th and it's a wrap, then I would say cool.
Something tells me it's going to be a bit more complicated than that haha.
Probably
