Yes they can. And a halfway decent chance they will.
I'm not sold SCOTUS is part of the plan. If SCOTUS is the plan, they won't hear it or rule until Oct. By Oct SCOTUS will likely be about 144 justices, so that plan is worthless.
I expect nothing to come of this, this is not the plan...
How do you know they will hear it in October? Did they already say something indicating that?
The normal procedure is this-
The conference is to decide if SCOTUS takes the case (take 4 justices to want the case). The spring cases aren't heard or decided until the fall.
Thanks for the info. Can't they choose to hear it earlier due to it's importance? Of course with Roberts there I feel like that may be wishful thinking.
I think the part you're missing is, if SCOTUS does things according to procedure, they won't hear the case till October. After that, they'll rule on it. Today is to decide if they want to hear it in October. Almost nothing comes of this today or anytime soon if they follow procedure.
Now, I can't tell you what the plan is, but having Biden destroy the country for another 7 months doesn't seem like a good plan to me. I could be wrong but I'll say it again, don't think SCOTUS is part of the plan.
