Its not double jeopardy because its not the same crime. They aren't charging him with murder, manslaughter, etc they are just saying Chauvin violated Floyd's civil rights. Its a lower level felony. Pretty sure the max is like 5 or 10 years. Truth be told I'm not sure they could convict him. Federal courts are much more robust in the way they pick juries and instruct them etc. The jury would be given proper instructions and would have no choice but the find him not guilty. That knee on the shoulder thing was proper procedure. You can't "brutalize" someone using a procedure that the whole force uses.
This whole thing is a joke. They can't snap their fingers and make an innocent man guilty. Chauvin needed to be fired from his job. That's it. There was nothing criminal about what happened. It was just a dick move. He should have taken his knee off him 2-3 minutes before he actually did. That's it. Everything else was by the book and perfectly fine. More importantly you can never ever ever prove "beyond a reasonable doubt" it caused Floyd's death. There will ALWAYS be doubt that it was 100% a drug OD.
Is it possible the knee is what killed him? Yes, but its not possible to prove that for sure. The default is INNOCENT until PROVEN guilty. Everyone is just ignoring that one simple thing. Chauvin was judged guilty by the mob before the trail even started. That's the whole problem. Criminal trails aren't supposed to work that way.
