In this case, you're right: they're being stupid. But often the answer is yes. There's a ton of subpoena abuse: many agencies issue "administrative subpoenas" that have no legal authority at all. If you ever get subpoenaed for anything, make sure it's legit before rolling over and doing a lot of work for someone else.
