Yes and no. They all take an oath to the constitution and they all should look to the constitution first when making their decisions. But a big difference is that police are 'hired' and sheriffs are elected by we the people. Police may (erroneously) feel they are beholding to their superior officers and must follow orders, but sheriffs are beholding to the people.
I don't know how to answer that. His job description and his oath, literally (imo) give him the backing to have those big kahunas, as you say. When the Constitution is on your side, it doesn't take a lot of courage to just observe it and do your job based on those tenants. However, Oregon is such a poo-show that yeah, maybe he has to be braver than the next guy. He's still too polite, imo. Saying, 'Let us do so' makes it seem like he's asking for her permission. Still, got to give him credit. He's doing what a whole lot of other sheriffs aren't, so that's a good thing and maybe it will remind the others how they are supposed to behave. We can hope and pray.
