The key word is "vaccine". The mRNA gene therapy is NOT a vaccine by any of the requirements under law. Just because Merriam-Webster dictionary, Wikipedia, and the CDC's web page changed the definition to fool the public doesn't change the legal definition found under 42 U.S. Code § 300aa–22. Again, the definition has not changed and would require an Act of Congress to change it.
I know there's more because I saw it earlier. There's several qualifiers to be a vaccine. Even this definition does not fit the mRNA gene therapy injectoid. Moderna has stated publicly that it does not prevent disease (COVID-19).
It also doesn't fit the listing for a 'Taxable vaccine':

Every Statute/Code/Law has a 'glossary' of definitions. You might have to go back a level or two to find the definitions. They must be defined or definitions of words would be changed willy-nilly. 'Up' would become 'down' and vice versa.
They already are immune to lawsuits. Vaccine injury normally end up in the vaccine court and taxpayers pay the bill.
