To begin with this will be a focus mainly on Ohio because it is different in every state. However I think everyone will find something useful or a starting point (if you have one already please feel free to share) for what we can actually do if something should come from this.
Situation: School is going to full time masks already after two weeks. I will not let my child wear a mask. I am looking to bring anything to the board meeting that is towards the end of the month to put a stop to this. I’ll use that as the starting point because I am learning all of this as I go. No school board meeting experience, no legal experience, etc.
I am reading through the Ohio constitution and my first question is from Article 1 section 21 a. “No federal, state, or local law or rule shall compel, directly or indirectly, any person, employer, or health care provider to participate in a health care system.” (2) “”health care system” means any public or private entity or program whose function or purpose includes the management or, processing of, enrollment of individuals for, or payment for, in full or in part, health care services, health care data, or health care information for its participants.”
I’m not guessing this is the key to unlocking our freedoms but it’s where my mind started. Please feel free to add any insight on this or anything you think would help us a community come up with a solution on this matter. Thanks frens

That post was what got me started on this path. When I finally had time to read it it wasn’t what the headline made out. It only applies to New Hampshire and (from my understanding) only allows issues to be brought to the school board meetings. Which to me sounds like they will just swat it down since the made the decision already. I could be wrong and this school board could have proper brain activity deep down but I am trying to get something to really show them we mean business. Thanks for the link tho
I am in Perrysburg Ohio and they denied our Mask exemption. We have him enrolled in OHVA for the time being but we plan on continuing the fight to get our son allowed to go without a mask. We also know that Anthony Wayne School which is near us and only a school district over is allowing mask exemption forms.
It’s looking like we will be doing that as well. I saw genuine fear when my daughter overheard masks are mandatory now. Lancaster city schools is what I’m dealing with. I’ll look into mask exemption forms but I’m not hopeful. Thanks fren

I'd utilize this OH revised code to further your argument. Mulligan's Restaurant fought Dictator Dewine and his covid1984 "enforcers". Owner refused to enforce mandates and kept fighting in court. Dewine eventually dropped the case against owner to avoid other restaurants following a precendent. Basically from what the employees have told me, Dewine knew he'd lose. Maybe try this angle with other like-minded parents. None of this goes away unless we fight for our rights. Godspeed to you fellow Patriot.
Thank you I will bring this up. I’m concerned because the masks they make everyone wear aren’t legally medical devices. I’m new to getting active in this stuff but who knows what will happen if I do bring it up. I know what will happen if I don’t and that’s worse because nothing is the answer to doing nothing. Maybe that will click in some people’s heads that is actually isnt a medical device and has no business being projected as one.

That is not the key and is aimed at all managed care systems. Definition is almost the same in every state. It relates to HMOs, providers(which includes pretty much anyone providing a service to a patient.
I cant remember it now, but the state of Ohio defines masks of all types as medical devices. And in state law no one is allowed to be discriminated against for chosing not to use anything defined as a medical device.
Tbat is the rout to take. Might want to see if there are respiratory therapists in the area who can speak.
Is also worth looking up OHSA guidlines for use of medical equipment not listed for use. Also worth looking into OSHA guidelines for masks approved for airborn contaminants and their ratings.
Thanks for the response. I was concerned they were wording that article and section the way you described. I do like the ideas you suggested. Attacking the mask itself is a good approach. I will research the masks more and see if there is something there. Obviously I know they don’t work and what not but get my thoughts in order I guess. Good idea as well for the OSHA guidelines. I tried to get Home Depot to get someone into the store I was working at to do oxygen tests but they said no go. I’ll see what the school board has to say about that.
Getting someone to test the air in a school is going to be hard, unless its a really old school and you go the allery rout to get it started.
I guess the biggest thing I left.out was not being afraid to speak. There are many many more people who think masks are BS and problematic. I think even the CDC did a study years ago showing they have no value for combatting the flu.

Possibly relevant, even if tangential. This post from u/#thejake links to a site that claims to track covid payments to school boards. Idea being if school board follows CDC rules, the board gets that much money. Possibly the real reason for all the mandates. Needs more transparency behind the money trail than just this link. But pay-to-mask sounds like a scandal to me. Maybe local pedes can get local school district reports to verify this.

I very much think they are getting paid for it. If not the school board members the districts are. My dad is on a school board and has been for decades. It’s the funding that stops them from even thinking about going against the grain. I don’t want to ask him questions about this topic because we disagree on covid unfortunately. I will definitely look into that tho. There could be something down that rabbit hole. Thanks!
