No official rules yet, but I have my letter drafted. Feel free to use. I am not an attorney, so if any legal people here have any input. I will gladly take it.
Letter:
OSHA, the Federal Government, the State of XXXXXX government nor XXXXXX management are authorized to give me medical advice or require a medical treatment of any kind. I do not consent to your unsolicited medical advice. This arbitrary mandate, which has no basis in the Constitution of the United States of America, Federal Code or the State of XXXXXX code, is a violation of my Human Rights and the autonomy I hold over my body as an American citizen. This pressure for me to disclose any medical status to you is a violation of HIPAA privacy laws and unsolicited medical advice may be viewed as medical malpractice. While I do not resign my position, I also will not comply with your request to disclose medical information or your request to receive any medical treatment; vaccine, test or otherwise.
You may want to cite your right to informed consent, which requires all test results, contents of vaccine and dangers associated with getting it. VAERS can be used to show it doesn't meet the minimum standard of safety. You will not be getting an "approved" vaccine either as it's my understanding that vaccine is not yet available in the US. Good luck.
I agree with the lack of the authorization. Your rights do not come.from being a citizen as you identifiy as a subordinated non-thinking vessel, adrift and in need of maritime rescue.
Consider their letter as a vessel adrift, for which you issued a switch way bill , performed salvage and file your claim in gold and silver.
Or given the fact they.approached you as a vessel, a corporate structure, sign it without prejuidice ucc-1-207 and/or 308.
Meaning you can sue them till smithereens under common law.
Whatever you do, rethink your first impulse and think hard on what I just wrote.
Good luck!
I don’t understand anything you said, it I appreciate it!
Very nice. Short, direct. I would consider changing "human rights" to "God given rights", but great letter.
💪
The fda approval had an entire page dedicated to exemptions. Learn them and cite one or more. Religious exemption is more than enough in most states to avoid it. If they don’t accept it, there will be problems for them in the near future.
Did you sign any documentation to work for this company? Because if you did, this letter will not prevent them from firing you outright. The reason companies have SOP documents or agreements to sign before you start working is to protect themselves from legal harm.
I promise you his on-boarding paperwork didnt include a medical tyranny clause.
It’s HIPAA, not HIPPA. And HIPAA protects your records from being obtained without your consent. That is its exclusive purpose. I work in an industry where I gather records, and HIPAA compliance is not specific to a doctor and an health insurance company.
Requesting my records doesn’t require me to provide them.
That may be, but your letter states there’s a HIPAA violation where there is none. HIPAA is about your medical records not being disclosed without your consent WHEN A 3rd PARTY IS INVOLVED. It has nothing to do with your personal consent.
Having any easily discredited “fact” in your letter makes it easy to discredit your entire letter on the assumption you don’t know what you’re talking about. It would be in your best interest to delete that specific misinformation.
You haven’t discredited anything. Maybe your comprehension skills are low, shilly handshake.
I’ve been on this site about 2 years under a different user name, the device I used to respond to you happened to be logged onto this one. Calling me a shill is the best you can do as a response, and that’s fine. I could care less. But I’m not wrong about HIPAA. I can recite half the damn law to you by heart as it’s very much my business to know it inside and out. So leaving your letter as is, and looking like a complete retard to your HR and their lawyers, as they also know HIPAA well…. Well that’s on you now. Good luck.
Ok shill.
Good comeback! 🤣
